Mediation and Arbitration
When parties are involved in a legal dispute, they often look to alternative legal solutions that avoid expensive and unpredictable litigation. Mediation and arbitration are the most common forms of alternative dispute resolution.
Mediation is a process where a third-party neutral mediator assists the parties in their effort to arrive at a voluntary settlement, thus controlling the outcome and avoiding the transactional costs and risks of expensive litigation.
Arbitration, like litigation, offers a formal judgment about the disputed matter, this is known as an adjudicated result. However, arbitration is typically streamlined and a less costly process. Arbitrators will hold a hearing, which acts as a trial without a jury and issue a written decision or award.
Shareholder Michael Cohen has been recognized by his peers as one of the top complex litigation mediators and arbitrators in Wisconsin. He has been mediating and arbitrating complex business litigation and coverage disputes for over 10‐plus years. As a mediator, he has an outstanding success rate in getting complex cases resolved. Mr. Cohen is a facilitative mediator who uses his 35 years of litigation experience in complex civil cases in both federal and state courts to add value to the settlement process by helping parties understand the risks of their litigation positions and the cost/benefit analysis of resolving their dispute.
