Meissner Tierney attorneys Mark D. Malloy and Matthew V. Fisher obtained summary judgment in a lawsuit filed in Winnebago County (Rockford), Illinois. The client, a national distributor in the convenience store industry, was sued for tortious interference with contract and conspiracy relating to its entry into the e-cigarette industry. Malloy and Fisher argued that Plaintiff’s claims violated the Illinois “new business rule” because the damages claimed, future lost profits in excess of $5 million, were too speculative for recovery due to Plaintiff’s lack of past profit history and entry into a new product market.
